12. Registration of business and premises

(1) The Registrar must register a business and issue a certificate of registration in respect thereof if—
(a) it is a type of business contemplated in section 9(1);
(b) the practices employed in the business in question are in compliance with the prescribed requirements; and
(c) the prescribed facilities for the type of business in question are available on or at the relevant premises.

 

(2) The Registrar must register premises and issue a certificate of registration in respect thereof within 21 days if—
(a) the premises complies with the prescribed requirements;
(b) the prescribed facilities for the business in question are available at the premises;
(c) the person in direct control of the premises has sufficient knowledge of the practices to be employed in the operation of the business and of the relevant provisions of this Act;
(d) in the case of a laboratory and multiplication facility, the responsible official of the technical operations at such premises is in possession of the prescribed qualifications, has sufficient knowledge of the practices to be employed in those operations and has sufficient knowledge of the relevant provisions of this Act; and
(e) the premises comply with such other requirements as may be prescribed.

 

(3) The certificates of registration of a business and premises are not transferable.
