The Minister of Electricity and Energy ("the Minister"), after consultation with the National Energy Regulator of South Africa ("NERSA") and the Minister of Finance, for the purposes of ensuring security of energy supply in the national interest, acting under Section 34(1)(b) of the Electricity Regulation Act, 2006 (Act No. 4 of 2006), as amended, ("the ERA"), has determined as follows:
| 1. | that new electricity transmission infrastructure is required to ensure the optimal supply of electricity; |
| 2. | having regard to the Integrated Resources Plan and Transmission Development Plan of 2024, 400 kV transmission power lines with associated transformation infrastructure, with a total length of approximately 1,164 kilometres, and located within one or more of these provinces Northern Cape, North-West and Gauteng are required; |
| 3. | that the electricity transmission infrastructure referred to in paragraph [2] above is to be procured in accordance with one or more cost-effective tendering procedures with are fair, equitable, transparent and competitive, from independent transmission providers, to be administered by the procurer identified in paragraph [5] below; |
| 4. | the buyer in respect of the electricity transmission infrastructure so procured shall be the National Transmission Company of South Africa SOC Limited, and the electricity transmission infrastructure shall be made available on to such buyer, and in accordance with the transmission services agreements and other project agreements to be concluded pursuant to the tendering procedure/s conducted; |
| 5. | the procurer in respect of those tendering procedures will be the Department of Electricity and Energy or any entity mandated by the Minister, as the procurer. |
| 6. | the role of the procurer will be to conduct one or more tendering procedures, including preparing any requests for proposals and/or related and associated documentation, drafting the transmission services agreements and other applicable project agreements, facilitating the conclusion of such agreements, and facilitating the satisfaction of any conditions precedent to implementation which are within its control; |
| 7. | the National Transmission Company of South Africa SOC Limited, is required by virtue of this determination to enter into the transmission services agreements and other project agreements prepared for purposes of procuring the electricity transmission infrastructure referred to in paragraph [2]; and |
| 8. | the transmission infrastructure procured under this Determination must be procured from independent transmission providers. |
