(1) | No person may conduct a take-off in an aeroplane with instruments or equipment that are not serviceable or that have been removed unless the aeroplane is operated in accordance with a COL, the provisions specified in the aeroplane flight manual or the conditions or limitations specified in a MEL, which has been approved by the Director and, in the opinion of the PIC, aviation safety will not be compromised. |
(2) | An air service operator shall establish an MEL for each type of aeroplane for which an MMEL has been approved by a State of Design of such an aeroplane: Provided such State is a Contracting State. |

(3) | No operator may operate an aeroplane in accordance with a MEL unless such MEL is carried on board the aeroplane. |
