(1) | Subject to the provisions of subregulation (2), an air service operator shall not operate an aeroplane at night or in IMC in an area where thunderstorms or other potentially hazardous weather conditions, regarded as detectable with airborne weather radars, may be expected to exist along the route unless such aeroplane is equipped with airborne weather radar equipment. |
(2) | In the case of a non-pressurized aeroplane, the airborne weather radar equipment may, however, be substituted by other approved equipment, which is capable of detecting thunderstorms and other potentially hazardous weather conditions, and of providing the flight crew with bearing and distance of such detected conditions. |
