(1) | An air service operator shall ensure that an ATS flight plan is completed for each flight operated under this Part unless the flight is operated on a series of flights as provided in subregulation (2) and for each sector, alerting service has not been requested and the aeroplane does not— |
(a) | depart or arrive at a controlled aerodrome; |
(b) | operate within or transit through any controlled or advisory airspace; or |
(c) | operate within an airway or advisory route unless crossing such at right angles. |
(2) | For the purposes of subregulation (1), a series of flights is deemed to occur as long as the following criteria are met— |
(a) | the series of flights shall not result in flight time longer than 90 minutes in total; |
(b) | no individual sector shall be longer than 30 minutes; and |
(c) | the time spent on the ground at each en route stop shall not exceed 30 minutes. |
