Application of Chapter to aircraft accidents and aircraft incidents |
(1) | This Chapter applies in respect of aircraft accidents and aircraft incidents in or over— |
(a) | the Republic; |
(b) | any place that is under the Republic's air traffic control; and |
(c) | any other place, if— |
(i) | the Republic is requested to investigate the aircraft accident and aircraft incident by an appropriate authority in terms of the Convention; or |
(ii) | the aircraft accident and aircraft incident involves an aircraft in respect of which, or that is operated by a person to whom, a South African aviation authorisation, aviation certificate or any aviation approval document has been issued. |
(2) | The application of this Chapter in respect of aircraft accidents and aircraft incidents referred to in section 12(4) is subject to such restrictions in the interests of national security as are provided in the Defence Act, 2002 (Act No. 42 of 2002), or as prescribed by the Minister. |
(3) | In this Chapter "department" means any department in the national sphere of Government. |
