143. Threat to safety and security

(1)If the Minister, after consultation with the Director is of the opinion that any action by any person or any group of persons is of such a nature that the safety or security of any person, aircraft, airport, heliport or aviation facility is being seriously and immediately threatened, he or she or any person designated by him or her for this purpose, may issue such orders as may be considered necessary to any person or group of persons to counter such action.

 

(2)An authorised person may take such steps as he or she considers necessary to ensure that an order referred to in subsection (1) is complied with.

 

(3)Any person who fails or who refuses to give effect to an order issued in terms of subsection (1) is guilty of an offence and on conviction liable to a fine or to imprisonment for a period not exceeding five years or to both such fine and imprisonment.
