9. Application of certain provisions of Act 32 of 1944

1)Save as is otherwise provided in this Act or in any other law, the provisions of the Magistrates’ Courts Act, 1944 (Act No. 32 of 1944), and of the rules made thereunder shall apply mutatis mutandis to children's courts, in so far as those provisions relate to -
i)the appointment and functions of officers;
ii)the issue and service of process;
iii)the appearance in court of advocates and attorneys;
iv)the conduct of proceedings;
v)the execution of judgments; and
vi)the imposition of penalties for non-compliance with orders of court, for obstruction of execution of judgments and for contempt of court, and in so far as no other provision has been made under section 60(1)(g) of this Act for any matter mentioned in this subsection other than in paragraph (iii).

 

2)Such records of the proceedings of a children’s court shall be kept and shall be accessible to such persons upon such conditions as to payment of fees and otherwise as may be prescribed.

 

3)The contents of a statement or a report of a social worker which has been lodged with a children’s court, shall not be disclosed for the purposes of any civil action except by order of any court to a court where such disclosure would be in the interest of any child mentioned in the report.
